On appeal, Patrick reviewed the trial court’s jury instructions, and the court’s refusal to instruct the jury on the affirmative defense of self-defense. A careful review of the trial testimony revealed that there was significant evidence from which the jury could conclude that the Defendant had acted in self-defense.
After Patrick submitted his Opening Brief on appeal, the prosecution eventually agreed that the trial court had erroneously failed to properly instruct the jury. The prosecution agreed that the Defendant’s conviction should be reversed, and that the case should be remanded for a new trial.
